Podmienky a záruky poskytovania zdravotnej starostlivosti

Všeobecné zmluvné podmienky poskytovania zdravotnej starostlivosti spoločnosťou City Clinic, s.r.o.

/ďalej len “VZP”/

I.

Úvodné ustanovenia

• Spoločnosť City Clinic s.r.o., so sídlom Prievozská 14, 821 09 Bratislava IČO: 47347023 DIČ: 2120158777 zapísaná v obchodnom registri Okresného súdu Bratislava I odd. Sro zložka č. 91176/B je poskytovateľom zdravotnej starostlivosti (ďalej len „Poskytovateľ“) Pacient je bližšie špecifikovaný vo VZP (bod 1.8. písm. f VZP) (ďalej len „Pacient“). Tieto VZP upravujú zmluvné vzťahy a vymedzujú práva a povinnosti medzi Poskytovateľom a Pacientom.

Pojmy a vzťahy neupravené Zmluvou a týmito VZP majú taký význam, aký im prideľujú platné a účinné právne predpisy na úseku zdravotnej starostlivosti a s tým súvisiacich činností, ako aj iné právne predpisy tvoriace súčasť právneho poriadku Slovenskej republiky.

VZP upravujú Právny vzťah Zdravotnej starostlivosti rámcovo. Právny vzťah Zdravotnej starostlivosti ako celok je predmetom právnej úpravy zákona č. 576/2004 Z.z. o zdravotnej starostlivosti, službách súvisiacich s poskytovaním zdravotnej starostlivosti a o zmene a doplnení niektorých zákonov v platnom znení (ďalej “zákon o zdravotnej starostlivosti”). Ustanovenia týkajúce sa poskytovania Zdravotnej starostlivosti sú obsiahnuté v týchto VZP najmä pre názorné vysvetlenie postavenia Pacienta a pre ozrejmenie jeho práv a povinností pri poskytovaní Zdravotnej starostlivosti podľa vyššie citovaných právnych predpisov a z dôvodu dovolenej úpravy vzťahu medzi Poskytovateľom a Pacientom nad rámec právnej úpravy obsiahnutej vo vyššie citovaných predpisoch.

• Poskytovateľ zdravotnej starostlivosti

Spoločnosť City Clinic s.r.o. (ďalej len “City Dental Clinic” alebo “Poskytovateľ”) je poskytovateľom zdravotnej starostlivosti, so sídlom na adrese Prievozská 14, 821 09 Bratislava IČO: 47347023, DIČ: 2120158777, zapísaná v obchodnom registri Okresného súdu Bratislava I odd. Sro zložka č. 91176/B, podľa povolenia vydaného orgánom príslušným podľa zákona č. 578/2004 Z.z. o poskytovateľoch zdravotnej starostlivosti, zdravotníckych pracovníkoch, stavovských organizáciách v zdravotníctve a o zmene a doplnení niektorých zákonov, v znení neskorších predpisov (ďalej “zákon o poskytovateľoch zdravotnej starostlivosti ”).

1.3.             Na účely týchto VZP majú nižšie uvedené pojmy nasledovný význam:

1. Zdravotná starostlivosť je súbor pracovných činností, ktoré vykonávajú zdravotnícki pracovníci, vrátane poskytovania liekov. Zdravotná starostlivosť je Poskytovateľom poskytovaná vo vecnom rozsahu podľa príslušného povolenia na poskytovanie Zdravotnej starostlivosti, ktoré Poskytovateľovi vydal príslušný organ verejnej moci a správy Slovenskej republiky.
2. Služby súvisiace s poskytovaním Zdravotnej starostlivosti sú služby uvedené v ustanoveniach 13 zákona o zdravotnej starostlivosti.
3. Zdravotný výkon je ucelená činnosť zdravotníckeho pracovníka, ktorá predstavuje základnú jednotku poskytovania zdravotnej starostlivosti.

1. Zdravotná dokumentácia je súbor údajov o zdravotnom stave osoby, o zdravotnej starostlivosti a o službách súvisiacich s poskytovaním zdravotnej starostlivosti tejto osobe.
2. Zdravotný stav je fyzický a mentálny stav Pacienta so všetkými jeho diagnózami, vrátane vrodených ochorení a alergií na konkrétne látky.
3. Pacient je každá fyzická osoba, ktorej Poskytovateľ poskytuje Zdravotnú starostlivosť.
4. Ošetrujúci zdravotnícky pracovník je zdravotnícky pracovník určený Poskytovateľom na poskytovanie Zdravotnej starostlivosti Pacientovi, ak je takýmto ošetrujúcim zdravotníckym pracovníkom lekár alebo zubný lekár, ide o ošetrujúceho lekára, ak je ošetrujúcim zdravotníckym pracovníkom sestra, ide o ošetrujúcu sestru.
5. Zubno-lekárska pohotovostná služba je zdravotná starostlivosť, ktorou sa zabezpečuje dostupnosť zdravotnej starostlivosti v rozsahu poskytovania špecializovanej zubno-lekárskej ambulantnej starostlivosti.
6. Odplata za poskytnuté služby (ďalej len “Odplata”) je suma, ktorú je Pacient povinný zaplatiť Poskytovateľovi za Zdravotnú starostlivosť, ktorá mu bola poskytnutá .
7. Balík služieb je súbor zliav a benefitov, na ktoré má Pacient právny nárok po zakúpení a uhradení plnej sumy za balík Poskytovateľovi. Pacient má na výber X druhov balíkov služieb, v ktorých sú definované zľavnené zdravotné výkony, na ktoré má Pacient na základe balíka nárok. Balík služieb je neprenosný.
8. Rodinný balík služieb je súbor zliav a benefitov, na ktoré má nárok určitý počet osôb v príbuzenskom/inom vzťahu za splnenia stanovených podmienok, po zakúpení a uhradení plnej sumy za balík Poskytovateľovi. Osoby oprávnené čerpať výhody zo zakúpeného balíka budú písomne definované v deň jeho zakúpenia. Rodinný balík služieb je neprenosný.
9. Kupón je súbor zliav a benefitov, na ktoré má Pacient nárok po uhradení plnej sumy za Kupón a jej pripísaní na účet Poskytovateľa. Pacient má nárok na konkrétne Zdravotné výkony po predložení kupónu zamestnancom poskytovateľa.
10. Prijímateľ kupónu je osoba, ktorá je oprávnená na poskytnutie zdravotnej starostlivosti podľa Kupónu.
11. Kupón na hodnotu je Kupón na hodnotu a darčekový Kupón na hodnotu, ktorý slúži výhradne na započítanie čiastky na ňom uvedenej oproti čiastke za poskytnuté služby  u Poskytovateľa.

 

• Poskytovateľ poskytuje za finančnú odplatu komplexné služby pre Pacientov v oblasti záchovnej stomatológie, ortodoncie, chirurgie, protetiky, implantológie, pedostomatológie, endodoncie, röntgenológie a dentálnej hygieny Zdravotníckymi pracovníkmi špecializovanými v danej oblasti a zubno-lekárskej pohotovostnej služby.

• U niektorých Pacientov môžu byť VZP dodatočne doplnené Špecifickými podmienkami a Zmluvou, ktorá musí byť podpísaná oboma zmluvnými stranami.

II.

Poskytovanie zdravotnej starostlivosti a Služieb súvisiacich s poskytovaním Zdravotnej starostlivosti.

• Pacient sa za účelom poskytnutia Zdravotnej starostlivosti u Poskytovateľa objedná telefonicky, osobne alebo prostredníctvom elektronického formuláru na stránke internetového sídla Poskytovateľa na termín ošetrenia.

Objednaný termín je záväzný pre Poskytovateľa aj pre Pacienta. Pacient je oprávnený kedykoľvek, najneskôr 24 hodín pred objednaným termínom, tento termín zrušiť alebo objednať sa na iný možný termín. V prípade Pacientov, ktorí majú naplánované extrakcie alebo implantácie je potrebné informovať Poskytovateľa o zrušení termínu najneskôr 48 hodín pred objednaným termínom. Objednaný termín je možné preobjednať len raz. Poskytovateľ si vyhradzuje právo poskytnúť pacientovi ďaľší termín až po úhrade za ošetrenie vopred online platbou.

• Ak má Pacient s Poskytovateľom uzatvorenú platnú a účinnú Zmluvu a uhradil Poskytovateľovi príslušný členský poplatok v súlade so Zmluvou a VZP, má nárok na zľavy a benefity vyplývajúce zo Zmluvy a VZP v rámci príslušného Balíka služieb, ktorý si slobodne vybral.

• Pred začatím liečby je Ošetrujúci zdravotnícky pracovník povinný informovať Pacienta o účele, povahe, možných následkoch, o možnostiach voľby navrhovaných postupov, ako aj rizikách odmietnutia poskytnutia Zdravotnej starostlivosti v súlade s ustanovením 6 zákona o zdravotnej starostlivosti. Ošetrujúci zdravotnícky pracovník je povinný poskytnúť poučenie diskrétne, jasne, zrozumiteľne a bez nátlaku, tak, aby mal Pacient dostatok času sa slobodne rozhodnúť pre informovaný súhlas.

• Pacient má právo na odmietnutie ponúkanej liečby, pričom sa o tom vyhotoví písomný záznam do zdravotnej dokumentácie Pacienta. Toto právo na odmietnutie sa nevzťahuje na prípady, v ktorých podľa všeobecne záväzného právneho predpisu možno poskytnúť Zdravotnú starostlivosť bez informovaného súhlasu.

• Pacient má právo na humánny a dôstojný prístup od Ošetrujúcich zdravotníckych pracovníkov, ochranu dôstojnosti a svojej telesnej a psychickej integrity.

• Pacient má ďalej právo na zachovanie mlčanlivosti Ošetrujúcich zdravotníckych pracovníkov o všetkých údajoch týkajúcich sa jeho zdravotného stavu.

• Poskytovateľ má právo odmietnuť ošetriť Pacienta v prípade zistenej zdravotnej kontraindikácie vzhľadom na povahu poskytovanej Zdravotnej starostlivosti a Zdravotného stavu Pacienta v ktorýchkoľvek deň, ako aj deň, kedy sa dostavil na ošetrenie. Rovnako si poskytovateľ vyhradzuje právo odmietnuť ošetriť pacienta, ktorý sa dostaví na vyšetrenie pod vplyvom alkoholu, iných omamných alebo psychotropných látok, správa sa vulgárne alebo agresívne, svojím správaním narúša pokojný chod kliniky a poskytovanie zdravotnej starostlivosti alebo inak ohrozuje alebo ruší personál kliniky, či iných pacientov.

• Prevádzkovateľ zabezpečuje Zdravotnú starostlivosť výlučne v časoch určených Prevádzkovateľom.

• Pacient berie na vedomie a súhlasí, že mu na základe Zmluvy alebo Balíka služieb v City Dental Clinic vzniká právny nárok len na tie Služby, ktoré sú výslovne definované v Zmluve, v Balíku služieb a VZP.

• Ak sa Pacient domnieva, že mu bola Zdravotná starostlivosť poskytnutá neodborne a chybne alebo mu bola spôsobená ujma na zdraví jedným z Ošetrujúcich zdravotníckych pracovníkov, má právo požiadať Poskytovateľa o nápravu. Táto žiadosť sa podáva písomne poštou na adresu Poskytovateľa City Dental Clinic, Prievozská 14, 821 09 Bratislava, alebo na e-mailovú adresu poskytovateľa uverejnenú webovej stránke.

• Pacient je povinný pri každom ošetrení informovať Ošetrujúceho lekára o všetkých skutočnostiach, ktoré by mohli mať vplyv na zdravotný stav Pacienta /anamnéze, infekčných ochoreniach, tehotenstve, akútnej nevoľnosti, resp. inej zmeny zdravotného stavu/. Poskytovateľ a Ošetrujúci lekár nenesú zodpovednosť za poškodenie alebo zhoršenie zdravotného stavu Pacienta, ktorý porušil túto povinnosť.

• Poskytovateľ poskytuje Pacientovi zdravotnú starostlivosť Ošetrujúcim lekárom individuálne určeným Poskytovateľom na základe povahy diagnózy Pacienta a potreby vykonania špecializovaných zdravotných výkonov u Pacienta.

III.

Poskytovanie a sprístupňovanie údajov zo Zdravotnej dokumentácie

• Podľa 19 ods. 2 zákona o zdravotnej starostlivosti Zdravotná dokumentácia obsahuje najmä:

1. osobné údaje Pacienta v rozsahu nevyhnutnom na jeho identifikáciu a zistenie anamnézy,
2. údaje o diagnózach, priebehu a výsledkoch vyšetrení súvisiacich so zdravotným stavom Pacienta
3. údaje o poučení a informovanom súhlase za každé ošetrenie podľa 6 zák. č. 576/2004 Z.z
4. údaje o rozsahu poskytnutej zdravotnej starostlivosti
5. epidemiologicky závažné skutočnosti
6. informácie a súhlas so spracovaním osobných údajov Pacienta

 

• Údaje zo zdravotnej dokumentácie sa poskytujú formou výpisu zo Zdravotnej dokumentácie a formou nahliadnutia do Zdravotnej dokumentácie.
• Pacient a iné oprávnené osoby majú právo na nahliadnutie do Zdravotnej dokumentácie po písomnom vyžiadaní od Poskytovateľa.
• Poskytovateľ je povinný poskytnúť výpis zo Zdravotnej dokumentácie v rozsahu, ktorý priamo súvisí s účelom vyžiadania, na základe písomného vyžiadania, inému Poskytovateľovi alebo inej osobe v súlade so zákonom o zdravotnej starostlivosti. Tento úkon je spoplatenený administratívnym poplatkom.

IV.

Odplata za poskytované služby, spôsob platenia a splatnosť

• Pacient je povinný uhradiť Poskytovateľovi Odplatu za poskytnutú Zdravotnú starostlivosť. Hradí plnú sumu podľa platného Cenníka, čím nie sú dotknuté ustanovenia bodov 4.2 až 4.4 VZP. Cenník je k dispozícii na nahliadnutie na recepcii City Dental Clinic.

• Výkony Zdravotnej starostlivosti, ktoré sú poskytnuté nad rámec výkonov dohodnutých v Zmluve, uvedených na zakúpenom Kupóne alebo v zakúpenom Balíku služieb ako hradené alebo čiastočne hradené (t.j. je na nich poskytnutá percentuálna zľava), hradí Pacient v plnej výške podľa aktuálneho Cenníka Poskytovateľa. Cenník je k dispozícii na nahliadnutie na recepcii City Dental Clinic. O povinnosti uhradiť výkony je povinný Pacienta informovať ošetrujúci lekár.

• Pacient neplatí len tie výkony, na ktoré má nárok na základe zakúpených Balíkov služieb, Kupónov alebo na základe Zmluvy s poskytovateľom.

• Splatnosť poskytnutej služby je vždy ihneď v prevádzkových priestoroch Poskytovateľa, pokiaľ sa strany nedohodnú inak. Pacient je povinný uhradiť sumu za poskytnutú službu v plnej výške v hotovosti alebo platobnou kartou na recepcii City Clinic s.r.o., pokiaľ sa zmluvné strany nedohodnú inak alebo si poskytovateľ neurčí akceptovaný spôsob platby.

• Poskytovateľ si vyhradzuje právo kedykoľvek zmeniť ceny poskytovaných služieb. Ceny musia byť vždy uverejnené v Cenníku dostupnom na webovej stránke Poskytovateľa a v tlačenej forme na recepcii City Dental Clinic.

V.

Záruka

•      Záruka poskytovaná na nasadzované korunky, zubné mostíky a zubné fixné náhrady je 2 roky. Záruka na zubné implantáty a implantátové nadstavby je 5 rokov. Záruka poskytovaná na prácu je 3 mesiace. Záruka poskytovaná na zubné výplne je 2 mesiace.

 

Podmienky poskytovanej záruky:

1. Pacient je povinný absolvovať pravidelné preventívne prehliadky každých 12 mesiacov v City Dental Clinic.
2. Pacient je povinný absolvovať profesionálne čistenie u dentálnej hygieničky každých 6 mesiacov v City Dental Clinic.
3. Pacient je povinný dodržiavať dennú hygienu ústnej dutiny: je nevyhnutné, aby venoval pozornosť starostlivosti o ústnu dutinu na dennej báze aj po nasadení zubných koruniek alebo po zavedení zubných implantátov zubnou kefkou, medzizubnými kefkami a dentálnou niťou.

•   Záruka uvedená v bode 5.1 sa nevzťahuje na vadu ak,

1. pacient neabsolvuje pravidelné preventívne prehliadky v City Dental Clinic v predpísanej frekvencii raz za 12 mesiacov, prípade v inej frekvencii určenej Ošetrujúcim lekárom
2. pacient trpí ochorením ďasien, parodontitídou
3. pacient potrebuje endodontické ošetrenie
4. pacient neuhradil odplatu v plnej sume
5. dôjde k poškodeniu korunky, mostíka, fazety, implantátu úrazom (pády, údery, nehody)
6. pacient trpí ochorením, ktoré by malo negatívny vplyv na stav chrupu (diabetes, autoimunitné ochorenia, epilepsia, rakovina a pod.)
7. pacient si dal sa bez vedomia City Dental Clinic vykonať opravy alebo zásahy do vykonaných prác
8. do prác sa vykonal zásah cudzím predmetom [napr. pilovane, upravovanie náhrady]
9. vznikla v dôsledku zahryznutia do cudzieho predmetu (napr.kov)
10. pacient zatajil anamnestických údajov
11. vznikla v dôsledku nesprávnej manipulácie s náhradou
12. vznikla v dôsledku nesprávnej manipulácie s náhradou mimo ústnej dutiny
13. vznikla v dôsledku odstránenia provizórnych náhrad bez oboznámenia lekára (pri tomto môže dôjsť k poškodeniu zubov, ktoré sú piliere pre protetickú prácu)

Záruka sa nevzťahuje ani na opakovaný výskyt zubného kazu, ktorému je možné zabrániť riadnou starostlivosťou, pravidelným čistením zubov, použitím liekov, ak je tak predpísané a dodržiavaním pravidelných preventívnych prehliadok.

• Uplatnenie nároku podľa tejto záruky má pacient  kedykoľvek pred uplynutím záručnej doby na konkrétny zákrok/produkt. Je potrebné, aby pacient telefonicky alebo emailom na adresu uvedenú na webovej stránke, vyplnením formulára na webovej stránke alebo písomne kontaktoval  Poskytovateľa vo veci nahlásenia reklamácie. Poskytovateľ poskytne pacientovi termín na ošetrenie. O oprávnenosti uplatnenia záruky rozhodne ošetrujúci lekár. Pacient je povinný pri plánovaní termínu u lekára uviesť povahu problému. Ak je reklamácia oprávnená, oprava alebo výmena bude vykonaná okamžite alebo naplánovaná na vhodnejší deň a čas v závislosti od povahy reklamácie. V prípade, že je potrebné vymeniť protetiku, je potrebné, aby pacient bral do úvahy čas potrebný na  zadováženie, opravu alebo úpravu protetickej časti.

VI.

Ochrana osobných údajov

• Všetky osobné údaje Klienta (na účely tohto článku môže byť Klient označený ako „Dotknutá osoba“) sa spracúvajú v súlade s ustanoveniami zákona č. 122/2013 Z.z., ustanoveniami zákona č. 576/2004 z. z. a ustanoveniami súvisiacich právnych predpisov.
• Dotknutá osoba týmto dáva prevádzkovateľovi svoj súhlas, aby spracúval jej osobné údaje v rozsahu: meno a priezvisko, trvalý pobyt, rodné číslo, dátum narodenia, telefónne číslo a emailovú adresu,  na účel:  poskytovanie služieb ambulancie, evidencie termínov v kalendári, štatistické hodnotenia.
• Dotknutá osoba má právo kedykoľvek odvolať svoj súhlas. Odvolanie súhlasu nemá vplyv na zákonnosť spracúvania vychádzajúceho zo súhlasu pred jeho odvolaním. Dotknutá osoba má právo súhlas odvolať zaslaním oznámenia e-mailom na mailovú adresu spoločnosti City Clinic s.r.o. gdpr@cityclinic.eu  alebo poštovou zásielkou na adresu sídla prevádzkovateľa Prievozská 14, Bratislava 821 09.
• Ďalšie informácie týkajúce sa spracúvania osobných údajov, ako právo požadovať od prevádzkovateľa prístup k osobným údajom, právo na opravu osobných údajov, právo na  výmaz osobných údajov alebo právo na obmedzenie spracúvania osobných údajov a pod., sú dostupné na webovom sídle prevádzkovateľa.
• Poskytovateľ je oprávnený vykonávať spracovateľské operácie, ktoré zodpovedajú účelu spracúvania, a to: získavať, zhromažďovať, zaznamenávať, usporadúvať, preskupovať, kombinovať, prehliadať, premiestňovať, uchovávať, kopírovať, skenovať, sprístupňovať a likvidovať osobné údaje, ďalej kontrolovať preukázanie pravdivosti poskytnutých osobných údajov, uchovávať osobné údaje vo vedenej dokumentácii, záznamy a súvisiacu evidenciu, počas archivačnej doby stanovenej všeobecne záväznými právnymi predpismi.
• Bližšie informácie týkajúce sa spracúvania osobných údajov sú dostupné na webovom sídle poskytovateľa: https://cityclinic.sk/podmienky-a-zaruky-poskytovania-zdravotnej-starostlivosti/. Klient je povinný oboznámiť sa s uvedeným vyhlásením o ochrane osobných údajov. Poskytovateľ nenesie zodpovednosť za následky, ktoré vzniknú klientovou neinformovanosťou o spracúvaní osobných údajov klienta.

 

VII

Zdravotná starostlivosť poskytovaná osobe nespôsobilej dať informovaný súhlas (ďalej “nespôsobilý pacient”)

•  Za osobu nespôsobilú dať informovaný súhlas sa považuje maloleté dieťa, osoba pozbavená spôsobilosti na právne úkony a osoba s obmedzenou spôsobilosťou na právne úkony.

•  Za nespôsobilého pacienta koná zákonný zástupca.
•  Pri poskytovaní zdravotnej starostlivosti je Ošetrujúci zdravotnícky pracovník povinný prihliadať na názor nespôsobilého pacienta, predovšetkým mu je povinný zrozumiteľným spôsobom vzhľadom na jeho vek a rozumovú vyspelosť vysvetliť podstatné skutočnosti týkajúce sa jeho zdravotného stavu. Zákonného zástupcu Ošetrujúci zdravotnícky pracovník poučuje v plnom rozsahu.
•  Neplnoletosť alebo pozbavenie/obmedzenie spôsobilosti Pacienta na právne úkony nie je dôvodom na porušovanie jeho osobnostných práv, ktoré je Poskytovateľ a Ošetrujúci zdravotnícky pracovník povinný rešpektovať v plnom rozsahu.
• Zákonný zástupca je povinný poskytovať Poskytovateľovi plnú súčinnosť tak, aby nebola ohrozená včasnosť a úplnosť zdravotnej starostlivosti, ktorú si zdravotný stav nespôsobilého Pacienta vyžaduje.
•  Zákonný zástupca Pacienta musí preukázať a podpisom potvrdiť v písomnom informovanom súhlase pri poskytovaní zdravotnej starostlivosti, že je zákonným zástupcom klienta .

VIII

Riešenie sporov a zodpovednosť za škodu

• Zmluvné strany sa zaväzujú, že prípadné spory alebo nedorozumenia budú riešiť primárne   vzájomnou komunikáciou.
• Pred tým, ako by ktorákoľvek zo zmluvných strán učinila úkon/podala návrh/podala sťažnosť   (napríklad na Úrad pre dohľad nad zdravotnou starostlivosťou, orgán činným v trestom konaní, súd), alebo problém medializovala (medializácia zahŕňa aj sociálne siete), zaväzuje sa najskôr vyzvať písomne druhú zmluvnú stranu na riešenie sporu a poskytnúť jej 15 dňovú lehotu, plynúcu od doručenia výzvy, na formulovanie stanoviska.
•  V každom štádiu riešenia sporu sa zmluvné strany zaväzujú postupovať tak, aby nepoškodili dobré meno a povesť druhej strany.
• Pacient berie na vedomie, že povaha poskytovania zdravotnej starostlivosti u Poskytovateľa môže vyžadovať odkladanie osobných vecí (ako napr. časti oblečenia, doklady a pod.).

Na tento účel Poskytovateľ vyhradzuje miesto na odkladanie osobných vecí Pacientov počas poskytovania zdravotnej starostlivosti tak, že Pacient je povinný odložiť svoje osobné veci vždy v tej miestnosti, v ktorej sa podľa povahy poskytovanej zdravotnej starostlivosti zdržuje. Pacient vyhlasuje, že tomuto opatreniu Poskytovateľa porozumel a berie ho na vedomie. Poskytovateľ nezodpovedá za škodu na veciach, ktoré si Pacient odloží inde, ako na mieste na to určenom.

IX.

Kupóny

• Klient má právo zakúpiť si ktorýkoľvek kupón ponúkaný na stránke poskytovateľa.

• Klient získava právo uplatniť kupón a čerpať zľavy a benefity z neho vyplývajúce jednorazovo v plnom rozsahu zahrnutých zdravotných výkonov, alebo postupne. Kupón je povinný predložiť zamestnancom poskytovateľa pred poskytnutím zdravotného výkonu vo vopred dohodnutom termíne.

• Kupón má obmedzenú časovú platnosť. Časová platnosť Kupónu a podmienky čerpania sú uvedené priamo na Kupóne alebo na webovej stránke Poskytovateľa. Ak nie je na Kupóne alebo na webovej stránke uvedená časová platnosť Kupónu, tak kupón je platný 1 rok odo dňa ———— Pacient sa zaväzuje s podmienkami oboznámiť a dodržiavať ich.

• Pacient je povinný pred uplatnením Kupónu telefonicky alebo e-mailom kontaktovať poskytovateľa a  rezervovať si termín s dostatočným predstihom.

• Po uplynutí doby platnosti Kupónu stráca Pacient nárok na poskytnutie zliav a benefitov vyplývajúcich z kupónu bez nároku na akúkoľvek refundáciu.

• Pacient má právo jedenkrát zmeniť Prijímateľa kupónu v prípade, ak poskytovateľa o tom informuje prostredníctvom emailu na adresu Poskytovateľa uverejnenú na webovej stránke. Informácie o novom prijímateľovi musí poskytnúť výhradne emailovou formou.

• V prípade zrušenia termínu menej než 24 hodín pred ošetrením alebo v prípade opakovaného presúvania termínu si Poskytovateľ vyhradzuje právo odmietnuť akékoľvek žiadosti o vrátenie sumy za zaplatený kupón a jeho využitie na úhradu ušlého zisku.
• Kupón na hodnotu a darčekový Kupón na hodnotu (ďalej spoločne len „Kupón na hodnotu“) slúži výhradne na započítanie čiastky na ňom uvedenej oproti čiastke za poskytnuté služby  u poskytovateľa. Kupón na hodnotu je klient oprávnený využiť od okamihu obdržania do konca platnosti uvedenej na webovej stránke poskytovateľa alebo na kupóne samotnom.

• Cenu kupónu môže kupujúci uhradiť  bezhotovostne prevodom na účet predávajúceho prostredníctvom online platobnej brány na webe Prijímateľa.

• Ak je kúpna zmluva uzatvorená na diaľku (prostredníctvom internetového obchodu), má kupujúci podľa zákona o ochrane spotrebiteľa pri predaji na diaľku právo bez uvedenia dôvodu a bez akejkoľvek sankcie odstúpiť od kúpnej zmluvy. Lehota na odstúpenie od zmluvy je 14 dní okamihom úspešnej platby za kupón.

 

X.

Balíky  služieb

• Klient má právo zakúpiť si jeden alebo viac balíkov z aktuálnej ponuky poskytovateľa. Počet ponúkaných balíkov a ich názvy určuje poskytovateľ.

• Balík má obmedzenú časovú platnosť jeden rok odo dňa zakúpenia. Zakúpením balíka Pacient vyjadruje súhlas s podmienkami užívania služieb zahrnutých v balíku.

• Pacient je povinný pri čerpaní výhod vyplývajúcich zo zakúpeného balíka alebo viacerých balíkov dodržiavať základné pravidlá týkajúce sa spôsobu objednávania a rezervácie termínu.

• V prípade Rodinného balíka služieb nie je podmienkou, aby osoby využívajúce výhody z neho plynúce boli v príbuzenskom vzťahu, avšak je podmienkou, aby osoby čerpajúce výhody z tohto  balíka boli maximálne v počte 4 osoby.
• Po uplynutí doby platnosti konkrétneho balíka stráca Pacient nárok na čerpanie výhod z neho plynúcich aj v prípade, že počas doby jeho platnosti tieto výhody nevyužil.

• Zakúpený balík je neprenosný. Po zakúpení Balíka nie je možné zmeniť prijímateľa výhod z neho vyplývajúcich. V prípade, že Pacient nebude schopný využiť služby a výhody z dôvodov nepredpokladaných, nepredvídateľných a z dôvodov, ktoré si Pacient nespôsobil sám, bude mu vrátená alikvótna čiastka po dohode s Poskytovateľom.

• V prípade uplynutia doby platnosti balíka alebo vyčerpania všetkých výhod z neho vyplývajúcich má klient možnosť na jeho opätovné zakúpenie.

XI

Vernostný program

• Súčasťou vernostného programu sa môže stať každá osoba, ktorá vyplní a odošle formulár na https://cityclinic.sk/loyal/ a následne bude osobne overená totožnosť v priestoroch City Dental Clinic.
• Podmienkou členstva vernostného programu je výhradné poskytovanie zdravotnej starostlivosti v oblasti zubného lekárstva a služieb s tým súvisiacich v City Dental Clinic.
• Účasťou vo Vernostnom programe získava účastník zľavu na všetky úkony vykonané v City Dental Clinic. Zľavu z Vernostného programu nie je možné kombinovať s inými zľavami Poskytovateľa.
• Poskytovateľ si vyhradzuje právo na ukončenie členstva akémukoľvek členovi, ktorý nebude spĺňať bod 11.2. týchto VOP
• Poskytovateľ si vyhradzuje právo Vernostný program kedykoľvek pozastaviť, pozmeniť jeho podmienky, alebo ho úplne zrušiť bez náhrady.

XII

Spoločné a záverečné ustanovenia

• Poskytovateľ má právo jednostranne meniť tieto VOP. Zmena VOP sa zverejní na webovom sídle poskytovateľa, na podstránke Podmienky a záruky poskytovania zdravotnej starostlivosti – cityclinic.sk/podmienky-a-zaruky-poskytovania-zdravotnej-starostlivosti/. Pacient je povinný oboznámiť sa so zmenami VOP. VOP dňom zverejnenia zároveň nadobúdajú účinnosť a nahrádzajú dovtedy účinné VOP.
• Právne vzťahy založené Zmluvou, ktoré v nej nie sú výslovne upravené sa riadia právnym poriadkom Slovenskej republiky.
• Ak niektoré ustanovenia VZP nie sú celkom alebo sčasti platné alebo účinné alebo neskôr stratia platnosť alebo účinnosť, nie je tým dotknutá platnosť ani účinnosť ostatných ustanovení VZP. Namiesto neplatných a/alebo neúčinných ustanovení sa použije právna úprava, ktorá, pokiaľ je to možné, sa čo najviac približuje zmyslu a účelu ustanovenia, ktoré je postihnuté neplatnosťou alebo neúčinnosťou.
• Pre vylúčenie akýchkoľvek nezrovnalostí a pochybností platí, že akákoľvek zásielka odoslaná poštou jednou zo zmluvných strán uvedených v Zmluve, sa považuje za doručenú adresátovi po uplynutí 5 pracovných dní odo dňa odoslania zásielky, ak sa nepreukáže doručenie v skoršom dátume.
• V prípade, že sa podľa Zmluvy alebo VZP predpokladá oznámenie skutočnosti Pacientovi oznámením na web stránke Poskytovateľa, považujú sa tieto oznámenia za oznámené dňom ich uverejnenia na stránke.
• V prípadoch, kedy sa predpokladá oznámenie skutočnosti Pacientovi elektronickou poštou, sa takéto oznámenie považuje za oznámené okamihom ich odoslania. Ak bola správa elektronickej pošty odoslaná mimo pracovných dní (t.j. sobota, nedela, dni pracovného pokoja a štátne sviatky), dňom doručenia sa považuje 09:00 hod najbližšieho nasledujúceho pracovného dňa.
• Akákoľvek zmena alebo doplnenie Zmluvy alebo VZP si vyžadujú písomnú formu.
• Podpisom sa Pacient zaväzuje dodržiavať podmienky dohodnuté v VZP. Pacient zároveň podpisom potvrdzuje, že sa podrobne oboznámil so VZP a prípadné nejasnosti mu boli vysvetlené Poskytovateľom.

Poisťovne

Pacient hradí plnú sumu za realizovanú zdravotnú starostlivosť podľa platného Cenníka. Uvádzané sumy v cenníku sú doplatkom k príspevku od poisťovní. Odplata za poskytované služby, spôsob platenia a splatnosť je podrobne uvedená vo Všobecných zmluvných podmienkach zdravotnej starostlivosti spoločnosti City Clinic, s.r.o.

General Terms and Conditions for the Provision of Healthcare by City Clinic, s.r.o.

/ hereinafter referred to as “GTC” /

1. Opening clause

1.1 The company City Clinic s.r.o., registered seat at Prievozská 14, 821 09 Bratislava IČO: 47347023 DIČ: 2120158777 entered in the Commercial Register of the District Court Bratislava I Sec. Ltd. folder No. 91176 / B is a healthcare provider (hereinafter referred to as the “Provider”). The patient is specified in details in the GTC (paragraph 1.3, f of the GTC) (hereinafter referred to as the “Patient”). These GTC regulate contractual relations and define the rights and obligations between the Provider and the Patient.

Terms and relations not regulated by the Agreement and these GTC have the meaning assigned to them by valid and effective legal regulations in the field of health care and related activities, as well as other legal regulations which are part of the legal order of the Slovak Republic.

GTC regulates the Legal Relationship of Health Care in a framework. The legal relationship of Health Care as a whole is the subject of the legal regulation of Act no. 576/2004 Coll. on Health Care, Services Related to the Provision of Health Care and on Amendments to Certain Acts, as amended (hereinafter referred to as the “Health Care Act”). Terms concerning the provision of Health Care are contained in these GTC in particular to illustrate the position of the Patient and in order to clarify his rights and obligations within the provision of Health Care according to the above-quoted legislation and allowed regulation of the relationship between the Provider and the Patient.

1.2 Healthcare provider

City Clinic s.r.o. (hereinafter referred to as “City Dental Clinic” or “Provider”) is a health care provider, registered seat at Prievozská 14, 821 09 Bratislava, ID number: 47347023, VAT number: 2120158777, registered in the Commercial Register of the District Court of Bratislava I, Sec. Ltd. folder No. 91176 / B, according to the permit issued by the competent authority pursuant to Act No. 578/2004 Coll. on Health Care Providers, Healthcare Workers, Professional Organizations in Health Care and on Amendments to Certain Acts, as amended (hereinafter referred to as the “Health Care Providers Act”).

1.3 For the purposes of these GTC, the following terms have the following meanings:

a) Healthcare is a set of work activities performed by healthcare professionals, including the provision of medicines. Healthcare is provided by the Provider to the extent necessary in accordance with the relevant permit for the provision of Healthcare issued to the Provider by the relevant public authority and administration of the Slovak Republic.
b) Services related to the provision of Health Care are services listed in the provisions of Act 13 of the Health Care Act.

c) Medical performance is a comprehensive activity of a medical professional, which represents the basic unit of health care provision.
d) Medical documentation is a set of data on the health status of a person, on health care and on services related to the provision of health care to this person.
e) Medical condition is the physical and mental condition of the Patient with all his diagnoses, including congenital diseases and allergies to specific substances.
f) A patient is any natural person to whom the Provider provides Healthcare.
g) The attending healthcare professional is a healthcare professional designated by the Provider to provide Healthcare to the Patient, if such attending healthcare professional is a doctor or dentist, it is a attending physician, if the attending healthcare professional is a nurse, it is a nurse.
h) Dental emergency service is health care, which ensures the availability of health care within the scope of providing specialized dental outpatient care.
i) Remuneration for the services provided (hereinafter referred to as “Remuneration”) is the amount that the Patient is obliged to pay to the Provider for the Healthcare provided to him.
j) The package of services is a set of discounts and benefits to which the Patient is legally entitled after purchasing and paying the full amount for the package to the Provider. The Patient can choose X types of packages, in which the discounted medical services to which the Patient is entitled on the basis of the package are defined. The service package is non-transferable.
k) A family package of services is a set of discounts and benefits to which a certain number of persons in a family / other relationship is entitled once they meet the specified conditions after purchasing and paying the full amount of the package to the Provider. Persons entitled to benefit from the purchased package will be defined in writing on the day of its purchase. The family package is non-transferable.
l) The Coupon is a set of discounts and benefits to which the Patient is entitled after payment of the full amount for the Coupon and its crediting to the Provider’s account. The patient is entitled to specific medical services after presenting the coupon to the provider’s employees.
m) The recipient of the coupon is a person who is authorized to receive health care under the Coupon.
n) Value Coupon is a Value Coupon and a Gift Value Coupon, which is used exclusively to offset the amount stated on it against the amount for services provided by the Provider.

1.4 The Provider provides, for a financial fee, comprehensive services for Patients in the field of restorative dentistry, orthodontics, surgery, prosthetics, implantology, pedostomatology, endodontics, radiology and dental hygiene by healthcare professionals specializing in the field and dental emergency services.

1.5 For some Patients, the GTC may be additionally supplemented by Specific Conditions and an Agreement, which must be signed by both parties.

Provision of health care and services related to the provision of health care

2.1 For the purpose of providing Healthcare, the Patient shall book the term of treatment at the Provider by telephone, in person or via an electronic form on the Provider’s website. The booked term is binding for the Provider as well as for the Patient. The patient is entitled at any time, no later than 24 hours before the booked term, to cancel it or to book another possible term. In the case of Patients who have planned extractions or implants, it is necessary to inform the Provider about the cancellation of the term no later than 48 hours before it is booked. The ordered date can be re-ordered only once. The provider reserves the right to provide the patient with another date only after payment for treatment in advance by online payment.

2.2 If the Patient has a valid and effective Agreement with the Provider and has paid the Provider the relevant membership fee in accordance with the Agreement and GTC, he/she is entitled to discounts and benefits arising from the Agreement and GTC within the relevant Service Package, which he has freely chosen.

2.3 Prior to the start of treatment, the attending healthcare professional is obliged to inform the Patient about the purpose, nature, possible consequences, options for the proposed procedures, as well as the risks of refusing to provide Healthcare in accordance with provision 6 of the Healthcare Act. The healthcare professional is obliged to provide instruction discreetly, clearly, intelligibly and without coercion, so that the Patient has sufficient time to freely decide on informed consent.

2.4 The patient has the right to refuse the proposed treatment and in this case a written record will be made in the patient’s medical records. This right of refusal does not apply to cases in which, according to a generally binding legal regulation, Healthcare can be provided without informed consent.

2.5 The patient has the right to humane and dignified approach from healthcare professionals, protection of dignity and physical and mental integrity.

2.6 The patient also has the right to maintain the confidentiality of the Healthcare Professionals regarding all data concerning his health condition.

2.7 The Provider has the right to refuse to treat the Patient in case of a detected medical contraindication due to the nature of the provided Healthcare and the Patient’s Health condition, on any day, as well as the day when he arrived for treatment. The Provider also reserves the right to refuse to treat a patient who appears to be under the influence of alcohol, other narcotics or psychotropic substances, behaves vulgarly or aggressively, disrupts the smooth running of the clinic and the provision of health care, or otherwise endangers or disrupts clinic staff or other patients.

2.8 The Provider provides Health Care exclusively at the times defined by the Provider.

2.9 The Patient acknowledges and agrees that, based on the Agreement or the Service Package at the City Dental Clinic, he has a legal right only to those Services that are explicitly defined in the Agreement, in the Service Package and GTC.

2.10 If the Patient considers that the Healthcare has been provided to him unprofessionally and incorrectly or has been harmed by one of the attending healthcare professional, he has the right to ask the Provider for redress. This request is submitted in writing by post to the Provider’s address City Dental Clinic, Prievozská 14, 821 09 Bratislava, or to the provider’s e-mail address published on the website.

2.11 During each treatment, the Patient is obliged to inform the Attending Physician about all facts that could affect the Patient’s health / anamnesis, infectious diseases, pregnancy, acute nausea, resp. other changes in health status. The Provider and the Attending Physician are not responsible for damage or deterioration of the health condition of the Patient who has violated this obligation.

2.12 The Provider provides the Patient with health care by the Attending Physician individually designated by the Provider on the basis of the nature of the Patient’s diagnosis and the need to perform specialized medical procedures to the Patient.

III. Providing and making available data from medical documentation

3.1 According to Section 19 par. 2 of the Health Care Act the medical documentation contains in particular:

personal data of the Patient to the extent necessary for his identification and medical history,
data on diagnoses, course and results of examinations related to the patient’s health condition
data on instruction and informed consent for each treatment according to Section 6 Act. no. 576/2004 Coll
information on the scope of health care provided
epidemiologically important facts
information and consent to the processing of the Patient’s personal data

3.2 Data from the medical documentation are provided in the form of an extract from the Medical Documentation and in the form of an inspection to the Medical Documentation.

3.3 The patient and other authorized persons have the right to inspect the Medical Documentation upon written request from the Provider.

3.4 The Provider is obliged to provide an extract from the Medical Documentation to the extent directly related to the purpose of the request, on the basis of a written request, to another Provider or another person in accordance with the Health Care Act.

Remuneration for services provided, method of payment and maturity

4.1. The Patient is obliged to pay the Provider the Remuneration for the provided Healthcare. He/she pays the full amount according to the valid Price List, which does not affect the provisions of points 4.2 to 4.4 of the GTC. The price list is available for inspection at the reception of the City Dental Clinic.

4.2 Healthcare services that are provided in addition to the services defined in the Contract or stated on the purchased Coupon or in the purchased Service Package as paid or partially paid (ie a percentage discount is provided), are paid by Patient in full according to the Provider’s current Price List. The price list is available for inspection at the reception of the City Dental Clinic. The attending physician is obliged to inform the Patient about the obligation to pay for the services.

4.3 The patient does not pay only for those services to which he is entitled on the basis of purchased Service Packages, Coupons or on the basis of the Agreement with the provider.

4.4 The maturity of payment for the provided service is always immediately in the Provider’s premises, unless the parties agree otherwise. The patient is obliged to pay the amount for the provided service in full in cash or by payment card at the reception of City Clinic s.r.o., unless the parties agree otherwise or the provider determines the accepted method of payment.

4.5 The Provider reserves the right to change the prices of the provided services at any time. Prices must always be published in the Price List available on the Provider’s website and in printed form at the City Dental Clinic reception.

Warranty

5.1 The warranty provided for crowns, dental bridges and fixed dental prostheses is 2 years. The warranty for dental implants and implant superstructures is 5 years. The warranty provided for the work is 3 months. The warranty provided for dental fillings is 2 months.

5.2 Conditions of the provided guarantee:

The patient is required to undergo regular preventive check-ups every 12 months at the City Dental Clinic.
The patient is obliged to undergo professional cleaning by a dental hygienist every 6 months at the City Dental Clinic.
The patient is obliged to observe daily oral hygiene: it is essential to pay attention to the care of the oral cavity on a daily basis even after the placement of dental crowns or after the introduction of dental implants with a toothbrush, interdental brushes and dental floss.

5.3. The guarantee referred to in point 5.1 does not cover a defect if,

the patient does not undergo regular preventive examinations at the City Dental Clinic at the prescribed frequency once every 12 months, or at another frequency determined by the attending physician
The patient suffers from gum disease, periodontitis
The patient needs endodontic treatment
The patient has not paid the full amount of the renumeration
The crown, bridge, veneer, implant will be damaged by injury (falls, blows, accidents)
The patient suffers from a disease that would have a negative effect on the condition of the teeth (diabetes, autoimmune diseases, epilepsy, cancer, etc.)
The patient has had repairs or interventions in the work performed carried out without the knowledge of the City Dental Clinic
work was performed by a foreign object [e.g. sawing, compensation adjustment]
was caused by a bite in a foreign object (eg metal)
The patient concealed the anamnestic data
was caused by improper handling of the replacement
was caused by improper handling of the prosthesis outside the oral cavity
was caused as a result of the removal of temporary restorations without the doctor’s knowledge (this can damage the teeth, which are the pillars for prosthetic work)

The warranty also does not cover the recurrence of dental caries, which can be prevented by proper care, regular cleaning of teeth, use of medicines, if prescribed and compliance with regular preventive examinations.

5.4 The patient can make a claim under this warranty at any time before the expiration of the warranty period for a specific procedure / product. It is necessary for the patient to contact the Provider by phone or email to the address provided on the website, by filling in the form on the website or in writing regarding the reporting of the complaint. The provider will provide the patient with an appointment for treatment. The attending physician will decide on the eligibility of the guarantee. The patient is obliged to state the nature of the problem when planning an appointment with a doctor. If the complaint is justified, the repair or replacement will be performed immediately or scheduled for a more suitable day and time, depending on the nature of the complaint. In case the prosthetic needs to be replaced, the patient needs to take into account the time required to install, repair or modify the prosthetic part.

Privacy

6.1 All personal data of the Client (for the purposes of this article, the Client may be designated as a “Affected Person”) are processed in accordance with the provisions of Act No. 122/2013 Coll., The provisions of Act no. 576/2004  Coll and the provisions of related legislation.

6.2 The data subject hereby consents to the operator to process his personal data in the range of: name and surname, permanent residence, birth number, date of birth, telephone number and email address, for the purpose of: provision of ambulance services, registration of calendar dates, statistical evaluations.

6.3 The person concerned has the right to withdraw his consent at any time. Withdrawal of consent shall not affect the lawfulness of the processing resulting from the consent prior to its withdrawal. The person concerned has the right to withdraw his consent by sending a notification by e-mail to the e-mail address of City Clinic s.r.o.  gdpr@cityclinic.eu or by post to the address of the registered seat of the provider Prievozská 14, Bratislava 821 09.

6.4 Further information concerning the processing of personal data, such as the right to request access to personal data from the controller, the right to rectify personal data, the right to delete personal data or the right to restrict the processing of personal data, etc., is available on the provider’s website.

6.5 The Provider is entitled to perform processing operations that correspond to the purpose of processing, namely: to acquire, collect, record, organize, regroup, combine, browse, transfer, store, copy, scan, make available and dispose of personal data, further check the veracity of personal data provided data, to store personal data in the kept documentation, records and related records, during the archiving period stipulated by generally binding legal regulations.

6.6 More detailed information regarding the processing of personal data is available on the provider’s website: https://cityclinic.sk/podmienky-a-zaruky-poskytovania-zdravotnej-starostlivosti. The client is obliged to get acquainted with the stated statement on personal data protection. The Provider is not responsible for the consequences arising from the client’s lack of information about the processing of the client’s personal data.

VII. Healthcare provided to a person incapable of giving informed consent (hereinafter “ineligible patient”)

7.1 A minor, a person deprived of legal capacity and a person with limited legal capacity are considered to be incapable of giving informed consent.

7.2 A legal representative acts on behalf of an ineligible patient.

7.3 When providing health care, the attending healthcare professional is obliged to take into account the opinion of an ineligible patient, in particular he is obliged to explain the essential facts concerning his health condition in a comprehensible manner with regard to his age and mental maturity. The legal representative is instructed in full by the attending healthcare professional.

7.4 Incompleteness or deprivation / restriction of the patient’s legal capacity is not a reason for violation of his personal rights, which the Provider and the attending Healthcare Worker are obliged to respect in full.

7.5 The legal representative is obliged to give the Provider full cooperation so that the timeliness and completeness of the health care required by the health condition of the ineligible Patient is not endangered.

7.6 The Patient’s Legal Representative must prove and confirm by signing in a written informed consent when providing health care that he / she is the Client’s legal representative.

VIII. Dispute resolution and liability for damages

8.1 The Contracting Parties undertake to resolve any disputes or misunderstandings primarily by mutual communication.

8.2 Before either party takes action / submits a complaint (for example, to the Health Care Supervisory Authority, a law enforcement agency, a court) or publicizes the problem in the media (media coverage also includes social networks), he/she is obliged to invite the other party in writing to settle the dispute and to give him/her a 15-day period from the date of receipt of the summons to formulate an opinion.

8.3 At each stage of the resolution of the dispute, the parties undertake to proceed in such a way as not to damage the good name and reputation of the other party.

8.4 The patient acknowledges that the nature of the provision of health care at the Provider may require the storage of personal belongings (such as parts of clothing, documents, etc.). For this purpose, the Provider reserves a place to store personal belongings of patients during the provision of health care, so that the Patient is obliged to store his personal belongings always in the room in which he stays according to the nature of the provided health care. The patient declares that he has understood this provision of the Provider and acknowledges it. The Provider is not liable for damage to items that the Patient puts away elsewhere than at a place designated for that purpose.

Coupons

9.1 The Patient has the right to purchase any coupon offered on the Provider’s website.

9.2 The Patient acquires the right to use a coupon and to draw discounts and benefits defined in it once in full for the included medical services, or consecutively. The coupon must be submitted to the provider’s employees before the provision of medical services within a pre-agreed period.

9.3 The coupon is limited in time. The time validity of the Coupon and the conditions of drawing are stated directly on the Coupon or on the Provider’s website. If the time validity of the Coupon is not stated on the Coupon or on the website, then the coupon is valid for 1 year from the date of payment. The patient is obliged to acquaint with the conditions of use and abide them.

9.4 Before applying for the Coupon, the patient is obliged to contact the provider by phone or e-mail and book an appointment well in advance.

9.5 After the expiration of the Coupon, the Patient loses the right to provide discounts and benefits resulting from the coupon without the right to any refund.

9.6 The Patient has the right to change the Recipient of the Coupon once, if he informs about it the Provider via email to the Provider’s address published on the website. Information about the new recipient must be provided exclusively by e-mail.

9.7 In case of cancellation less than 24 hours before the treatment or in case of repeated postponement of the term, the Provider reserves the right to reject any requests for a refund of the coupon paid and its use to cover lost profits.

9.8Value Coupon and Gift Value Coupon (hereinafter collectively referred to as the “Value Coupon”) is used exclusively to offset the amount stated on it against the amount for services provided by the Provider. The client is entitled to use the coupon for value from the moment of receipt until the end of validity stated on the provider’s website or on the coupon itself.

9.9 The price of the coupon can be paid by the buyer by non-cash transfer to the seller’s account via the online payment gateway on the Recipient’s website.

9.10 If the purchase contract is concluded at a distance (via an online store), the buyer has the right to withdraw from the purchase contract without giving a reason and without any sanction under the Consumer Protection Act. The period for withdrawal from the contract is 14 days at the time of successful payment for the coupon.

Service packages

10.1 The patient has the right to purchase one or more packages from the current offer of the provider. The number of packages offered and their names is determined by the provider.

10.2 The package is limited in time for one year from the date of purchase. By purchasing the package, the patient agrees to the terms of use of the services included in the package.

10.3 The patient is obliged to observe the basic rules concerning the method of ordering and booking an appointment when drawing the benefits resulting from the purchased package or several packages.

10.4 In the case of a Family Package, it is not a condition that the persons benefiting from it are in a family relationship, but it is a condition that the persons benefiting from this package are a maximum of 4 persons.

10.5 After the expiration of the validity of a particular package, the Patient loses the right to draw the benefits resulting from it, even if he has not used these benefits during the period of its validity.

10.6 The purchased package is non-transferable. After purchasing the Package, it is not possible to change the recipient of the benefits resulting from it. In the event that the Patient will not be able to use the services and benefits for reasons unforeseen, unforeseeable and for reasons that the Patient did not cause himself, a pro rata amount will be refunded upon agreement with the Provider.

10.7 In the event of the expiration of the validity of the package or the exhaustion of all benefits resulting from it, the patient has the opportunity to purchase it again.

Common and final provisions

11.1 The Provider has the right to unilaterally change these GTC. The change of the GTC will be published on the provider’s website, on the subpage Conditions and guarantees of the provision of health care – cityclinic.sk/podmienky-a-zaruky-poskytovania-zdravotnej-starostlivosti/. The patient is obliged to get acquainted with the changes of the GTC. At the same time, the GTC take effect on the day of publication and replace the hitherto effective GTC.

11.2 Legal relations established by the Contract, which are not explicitly regulated in it, are governed by the law of the Slovak Republic.

11.3 If some provisions of the GTC are not valid or effective in whole or in part or later lose their validity or effectiveness, this does not affect the validity or effectiveness of other provisions of the GTC. Instead of invalid and / or ineffective provisions, legislation shall be applied which, as far as possible, is as close as possible to the meaning and purpose of the provision which is affected by invalidity or ineffectiveness.

11.4 For the avoidance of any discrepancies and doubts, any consignment sent by post by one of the contracting parties specified in the Contract shall be deemed to have been delivered to the addressee after 5 working days from the date of dispatch, unless delivery is proved at an earlier date.

11.5 In the event that, according to the Contract or the GTC, notification of the fact to the Patient by a notice on the Provider’s website is assumed, these notifications shall be deemed to have been announced on the day of their publication on the website.

11.6 In cases where notification of the fact to the Patient by e-mail is expected, such notification shall be deemed to have been notified at the time of sending it. If the e-mail message was sent outside working days (i.e. Saturday, Sunday, non-working days and public holidays), the day of delivery is considered to be 09:00 on the next following working day.

11.7 Any amendment or supplement to the Contract or GTC requires a written form.

11.8 By signing, the Patient undertakes to comply with the conditions agreed in the GTC. At the same time, the patient confirms with his signature that he has read the GTC in detail and that any ambiguities have been explained to him by the Provider.

11.9 In case of any discrepancies between Slovak and English version of GTC, the Slovak version will prevail.

Insurance companies

The patient pays the full amount for the health care provided according to the valid Price List. The amounts stated in the price list are a supplement to the contribution from insurance companies. The remuneration for the services provided, the method of payment and the due date are detailed in the General Terms and Conditions of Health Care of City Clinic, s.r.o.

Allgemeine Geschäftsbedingungen für die Bereitstellung von Gesundheitsleistungen durch City Clinic, s.r.o.

/ im Folgenden als “AGB” bezeichnet /

Eröffnungsklausel

1.1 Die Firma City Clinic s.r.o., eingetragener Sitz in Prievozská 14, 821 09 Bratislava IČO: 47347023 DIČ: 2120158777 eingetragen im Handelsregister des Bezirksgerichts Bratislava I Sec. Ltd. Ordner Nr. 91176 / B ist ein Gesundheitsdienstleister (im Folgenden als “Anbieter” bezeichnet). Der Patient ist in den AGB (Absatz 1.3, f der AGB) (im Folgenden als „Patient“ bezeichnet) detailliert angegeben. Diese AGB regeln die Vertragsbeziehungen und definieren die Rechte und Pflichten zwischen dem Anbieter und dem Patienten.

Begriffe und Beziehungen, die nicht durch die Vereinbarung und diese AGB geregelt sind, haben die Bedeutung, die ihnen durch gültige und wirksame gesetzliche Vorschriften im Bereich der Gesundheitsversorgung und damit verbundener Tätigkeiten sowie durch andere gesetzliche Vorschriften, die Teil der Rechtsordnung der Slowakischen Republik sind, zugewiesen wurde .

Die AGB regeln das Rechtsverhältnis des Gesundheitswesens in einem Rahmen. Das Rechtsverhältnis des gesamten Gesundheitswesens ist Gegenstand der gesetzlichen Regelung des Gesetzes Nr. 576/2004 Slg. über das Gesundheitswesen, Dienstleistungen im Zusammenhang mit der Erbringung von Gesundheitsleistungen und über Änderungen bestimmter Gesetze in der jeweils gültigen Fassung (im Folgenden als „Gesundheitsgesetz“ bezeichnet). In diesen AGB sind Bestimmungen zur Bereitstellung von Gesundheitsleistungen enthalten, insbesondere zur Veranschaulichung der Position des Patienten und zur Klärung seiner Rechte und Pflichten bei der Bereitstellung von Gesundheitsleistungen gemäß den oben genannten Gesetzen und der zulässigen Regulierung des Verhältnisses zwischen der Anbieter und der Patient.

1.2 Gesundheitsdienstleister

City Clinic s.r.o. (im Folgenden als „City Dental Clinic“ oder „Provider“ bezeichnet) ist ein Gesundheitsdienstleister mit Sitz in Prievozská 14, 821 09 Bratislava, ID-Nummer: 47347023, Umsatzsteuer-Identifikationsnummer: 2120158777, eingetragen im Handelsregister des Bezirksgerichts von Bratislava I, Sec. Ltd. Ordner Nr. 91176 / B, gemäß der von der zuständigen Behörde gemäß Gesetz Nr. 578/2004 Coll. zu Gesundheitsdienstleistern, Beschäftigten im Gesundheitswesen, Berufsverbänden im Gesundheitswesen und zu Änderungen bestimmter Gesetze in der jeweils gültigen Fassung (im Folgenden als „Gesetz über Gesundheitsdienstleister“ bezeichnet).

1.3 Für die Zwecke dieser AGB haben die folgenden Begriffe folgende Bedeutung:

a) Gesundheitswesen ist eine Reihe von Arbeitsaktivitäten, die von Angehörigen der Gesundheitsberufe durchgeführt werden, einschließlich der Bereitstellung von Medikamenten. Die Gesundheitsversorgung wird vom Anbieter in dem Umfang erbracht, der gemäß der entsprechenden Genehmigung für die Bereitstellung der Gesundheitsversorgung erforderlich ist, die dem Anbieter von der zuständigen Behörde und Verwaltung der Slowakischen Republik erteilt wurde.
b) Dienstleistungen im Zusammenhang mit der Erbringung von Gesundheitsleistungen sind Dienstleistungen, die in den Bestimmungen von Gesetz 13 des Gesundheitsgesetzes aufgeführt sind.
c) Die medizinische Leistung ist eine umfassende Tätigkeit eines Arztes, die die Grundeinheit der Gesundheitsversorgung darstellt.
d) Die medizinische Dokumentation besteht aus einer Reihe von Daten zum Gesundheitszustand einer Person, zur Gesundheitsversorgung und zu Dienstleistungen im Zusammenhang mit der Bereitstellung von Gesundheitsversorgung für diese Person.
e) Der medizinische Zustand ist der physische und psychische Zustand des Patienten mit all seinen Diagnosen, einschließlich angeborener Krankheiten und Allergien gegen bestimmte Substanzen.
f) Ein Patient ist eine natürliche Person, für die der Anbieter eine Gesundheitsversorgung bereitstellt.
g) Der behandelnde Arzt ist ein vom Anbieter zur Bereitstellung von Gesundheitsleistungen für den Patienten benannter Arzt. Wenn dieser behandelnde Arzt ein Arzt oder Zahnarzt ist, ist er ein behandelnder Arzt. Wenn der behandelnde Arzt eine Krankenschwester ist, ist er ein Arzt Krankenschwester.
h) Der zahnärztliche Notdienst ist die Gesundheitsversorgung, die die Verfügbarkeit der Gesundheitsversorgung im Rahmen einer spezialisierten zahnärztlichen ambulanten Versorgung sicherstellt.
i) Die Vergütung für die erbrachten Dienstleistungen (im Folgenden als „Vergütung“ bezeichnet) ist der Betrag, den der Patient dem Leistungserbringer für die ihm erbrachte Gesundheitsversorgung zu zahlen hat.
j) Das Leistungspaket besteht aus einer Reihe von Rabatten und Vorteilen, auf die der Patient nach dem Kauf und der Zahlung des vollen Betrags für das Paket an den Anbieter gesetzlich Anspruch hat. Der Patient kann X Arten von Paketen auswählen, in denen die ermäßigten medizinischen Leistungen definiert sind, auf die der Patient aufgrund des Pakets Anspruch hat. Das Servicepaket ist nicht übertragbar.
k) Ein Familienpaket von Dienstleistungen ist eine Reihe von Rabatten und Leistungen, auf die eine bestimmte Anzahl von Personen in einer familiären / anderen Beziehung Anspruch hat, sobald sie die angegebenen Bedingungen erfüllen, nachdem sie den vollen Betrag des Pakets gekauft und an den Anbieter gezahlt haben. Personen, die Anspruch auf das gekaufte Paket haben, werden am Tag des Kaufs schriftlich festgelegt. Das Familienpaket ist nicht übertragbar.
l) Der Gutschein ist eine Reihe von Rabatten und Vorteilen, auf die der Patient nach Zahlung des vollen Betrags für den Gutschein und dessen Gutschrift auf dem Konto des Anbieters Anspruch hat. Der Patient hat Anspruch auf bestimmte medizinische Leistungen, nachdem er den Coupon den Mitarbeitern des Anbieters vorgelegt hat.
m) Der Empfänger des Gutscheins ist eine Person, die berechtigt ist, im Rahmen des Gutscheins eine medizinische Versorgung zu erhalten.
n) Geld Gutschein ist ein Value Coupon und ein Gift Value Coupon, die ausschließlich dazu verwendet werden, den darauf angegebenen Betrag mit dem Betrag für vom Anbieter erbrachte Dienstleistungen zu verrechnen.

1.4 Der Anbieter bietet gegen eine finanzielle Gebühr umfassende Dienstleistungen für Patienten in den Bereichen restaurative Zahnheilkunde, Kieferorthopädie, Chirurgie, Prothetik, Implantologie, Pedostomatologie, Endodontie, Radiologie und Zahnhygiene durch auf diesem Gebiet spezialisierte medizinische Fachkräfte und zahnärztliche Notfalldienste an.

1.5 Für einige Patienten kann die AGB zusätzlich durch spezifische Bedingungen und eine Vereinbarung ergänzt werden, die von beiden Parteien unterzeichnet werden muss.

Bereitstellung von Gesundheitsleistungen und Dienstleistungen im Zusammenhang mit der Bereitstellung von Gesundheitsleistungen

2.1 Zur Erbringung der Gesundheitsversorgung muss der Patient die Behandlungsdauer beim Anbieter telefonisch, persönlich oder über ein elektronisches Formular auf der Website des Anbieters buchen. Die gebuchte Laufzeit ist sowohl für den Anbieter als auch für den Patienten verbindlich. Der Patient ist jederzeit berechtigt, spätestens 24 Stunden vor dem gebuchten Termin zu kündigen oder einen anderen möglichen Termin zu buchen. Im Fall von Patienten, die Wenn Extraktionen oder Implantate geplant sind, muss der Anbieter spätestens 48 Stunden vor der Buchung über die Stornierung der Laufzeit informiert werden. Der gebuchte Termin kann nur einmal umgebucht werden. Der Anbieter behält sich das Recht vor, dem Patienten erst nach Bezahlung der Behandlung im Voraus per Online-Zahlung einen ander Termin zu buchen.

2.2 Wenn der Patient eine gültige und wirksame Vereinbarung mit dem Anbieter hat und dem Anbieter den entsprechenden Mitgliedsbeitrag gemäß der Vereinbarung und den AGB gezahlt hat, hat er Anspruch auf Rabatte und Vorteile, die sich aus der Vereinbarung und den AGB innerhalb des entsprechenden Servicepakets ergeben , die er frei gewählt hat.

2.3 Vor Beginn der Behandlung ist das behandelnde medizinische Fachpersonal verpflichtet, den Patienten über den Zweck, die Art, die möglichen Folgen, die Optionen für die vorgeschlagenen Verfahren sowie über das Risiko der Verweigerung der Bereitstellung der Gesundheitsversorgung gemäß Bestimmung 6 des Gesetzes zu informieren Gesundheitsgesetz. Das medizinische Fachpersonal ist verpflichtet, diskret, klar, verständlich und ohne Zwang Anweisungen zu erteilen, damit der Patient genügend Zeit hat, um frei über die Einwilligung nach Aufklärung zu entscheiden.

2.4 Der Patient hat das Recht, die vorgeschlagene Behandlung abzulehnen. In diesem Fall wird eine schriftliche Aufzeichnung in den Krankenakten des Patienten erstellt. Dieses Verweigerungsrecht gilt nicht für Fälle, in denen das Gesundheitswesen gemäß einer allgemein verbindlichen gesetzlichen Regelung ohne Einverständniserklärung erbracht werden kann.

2.5 Der Patient hat das Recht auf einen humanen und würdigen Umgang von Angehörigen der Gesundheitsberufe, den Schutz der Würde sowie der körperlichen und geistigen Unversehrtheit.

2.6 Der Patient hat auch das Recht, die Vertraulichkeit der Angehörigen der Gesundheitsberufe in Bezug auf alle Daten zu seinem Gesundheitszustand zu wahren.

2.7 Der Anbieter hat das Recht, die Behandlung des Patienten im Falle einer festgestellten medizinischen Kontraindikation aufgrund der Art der erbrachten Gesundheitsversorgung und des Gesundheitszustands des Patienten an jedem Tag sowie an dem Tag, an dem er zur Behandlung ankam, zu verweigern.

2.8 Der Anbieter erbringt die Gesundheitsversorgung ausschließlich zu den vom Anbieter festgelegten Zeiten.

2.9 Der Patient erkennt an und stimmt zu, dass er auf der Grundlage der Vereinbarung oder des Servicepakets in der City Dental Clinic nur ein Recht auf die Services hat, die in der Vereinbarung, im Servicepaket und in den AGB ausdrücklich definiert sind.

2.10 Wenn der Patient der Ansicht ist, dass ihm die Gesundheitsversorgung unprofessionell und unkorrekt zur Verfügung gestellt wurde oder von einem der behandelnden Angehörigen der Gesundheitsberufe geschädigt wurde, hat er das Recht, den Leistungserbringer um Entschädigung zu bitten. Diese Anfrage wird schriftlich per Post an die Adresse des Anbieters, City Dental Clinic, Prievozská 14, 821 09 Bratislava, oder an die auf der Website veröffentlichte E-Mail-Adresse des Anbieters gesendet.

2.11 Während jeder Behandlung ist die Patientin verpflichtet, den behandelnden Arzt über alle Tatsachen zu informieren, die die Gesundheit / Anamnese der Patientin, Infektionskrankheiten, Schwangerschaft, akute Übelkeit bzw. andere Änderungen des Gesundheitszustands. Der Anbieter und der behandelnde Arzt sind nicht verantwortlich für Schäden oder Verschlechterungen des Gesundheitszustands des Patienten, der gegen diese Verpflichtung verstoßen hat.

2.12 Der Anbieter versorgt den Patienten durch den vom Anbieter individuell benannten behandelnden Arzt auf der Grundlage der Art der Diagnose des Patienten und der Notwendigkeit, spezielle medizinische Verfahren für den Patienten durchzuführen.

Bereitstellung und Bereitstellung von Daten aus medizinischen Unterlagen

3.1 Nach § 19 Abs. 2 des Gesundheitsgesetzes enthält die medizinische Dokumentation insbesondere:

personenbezogene Daten des Patienten, soweit dies für seine Identifizierung und Krankengeschichte erforderlich ist,

3.2 Daten aus der medizinischen Dokumentation werden in Form eines Auszugs aus der medizinischen Dokumentation und in Form einer Inspektion der medizinischen Dokumentation bereitgestellt.

3.3 Der Patient und andere befugte Personen haben das Recht, die medizinische Dokumentation auf schriftliche Anfrage des Anbieters einzusehen.

3.4 Der Anbieter ist verpflichtet, einem anderen Anbieter oder einer anderen Person gemäß dem Gesundheitsgesetz auf der Grundlage eines schriftlichen Antrags einen Auszug aus der medizinischen Dokumentation in dem Umfang zur Verfügung zu stellen, der in direktem Zusammenhang mit dem Zweck des Antrags steht.

Vergütung für erbrachte Dienstleistungen, Zahlungsweise und Fälligkeit

4.1. Der Patient ist verpflichtet, dem Leistungserbringer die Vergütung für die erbrachte Gesundheitsversorgung zu zahlen. Er / sie zahlt den vollen Betrag gemäß der gültigen Preisliste, die die Bestimmungen der Punkte 4.2 bis 4.4 der AGB nicht berührt. Die Preisliste kann an der Rezeption der City Dental Clinic eingesehen werden.

4.2 Gesundheitsdienstleistungen, die zusätzlich zu den im Vertrag definierten oder auf dem gekauften Coupon oder im gekauften Servicepaket als bezahlt oder teilweise bezahlt angegebenen Leistungen erbracht werden (dh es wird ein prozentualer Rabatt gewährt), werden vom Patienten vollständig gemäß der Aktuelle Preisliste des Anbieters. Die Preisliste kann an der Rezeption der City Dental Clinic eingesehen werden. Der behandelnde Arzt ist verpflichtet, den Patienten über die Zahlungspflicht für die Leistungen zu informieren.

4.3 Der Patient zahlt nicht nur für die Leistungen, auf die er aufgrund gekaufter Leistungspakete, Gutscheine oder aufgrund der Vereinbarung mit dem Anbieter Anspruch hat.

4.4 Die Fälligkeit der Zahlung für die erbrachte Dienstleistung erfolgt immer sofort in den Räumlichkeiten des Anbieters, sofern die Parteien nichts anderes vereinbaren. Der Patient ist verpflichtet, den Betrag für die erbrachte Leistung vollständig in bar oder per Zahlungskarte an der Rezeption von City Clinic s.r.o. zu bezahlen, sofern die Parteien nichts anderes vereinbaren oder der Anbieter die akzeptierte Zahlungsmethode festlegt.

4.5 Der Anbieter behält sich das Recht vor, die Preise der erbrachten Leistungen jederzeit zu ändern. Die Preise müssen immer in der Preisliste veröffentlicht werden, die auf der Website des Anbieters verfügbar ist, und in gedruckter Form an der Rezeption der City Dental Clinic

Garantie

5.1 Die Garantie für Kronen und Zahnbrücken beträgt 2 Jahre. Die Garantie für Zahnimplantate und Implantataufbauten beträgt 5 Jahre. Die Garantie für die Arbeiten beträgt 3 Monate.

5.2 Bedingungen der gewährten Garantie:

Der Patient muss sich alle 12 Monate einer regelmäßigen Vorsorgeuntersuchung in der City Dental Clinic unterziehen.
Der Patient muss sich alle 6 Monate einer professionellen Reinigung durch einen Zahnarzt in der City Dental Clinic unterziehen.
Der Patient ist zur täglichen Mundhygiene verpflichtet: Es ist wichtig, auch nach dem Einsetzen der Zahnkronen oder nach dem Einsetzen von Zahnimplantaten mit Zahnbürste, Interdentalbürsten und Zahn täglich auf die Pflege der Mundhöhle zu achten Zahnseide.

5.3. Die in Ziffer 5.1 genannte Garantie deckt keinen Mangel ab, wenn

Der Patient wird nicht regelmäßig alle 12 Monate in der vorgeschriebenen Häufigkeit oder in einer anderen vom behandelnden Arzt festgelegten Häufigkeit vorbeugenden Untersuchungen in der City Dental Clinic unterzogen
Der Patient leidet an Zahnfleischerkrankungen, Parodontitis
Der Patient benötigt eine endodontische Behandlung
Der Patient hat nicht den vollen Betrag der Vergütung bezahlt
Krone, Brücke, Furnier und Implantat werden durch Verletzungen (Stürze, Schläge, Unfälle) beschädigt.
Der Patient leidet an einer Krankheit, die sich negativ auf den Zustand der Zähne auswirken würde (Diabetes, Autoimmunerkrankungen, Epilepsie, Krebs usw.).
Der Patient hat Reparaturen oder Eingriffe in die durchgeführten Arbeiten ohne Wissen der City Dental Clinic durchgeführt
Die Arbeit wurde von einem Fremdkörper ausgeführt [z. Sägen, Ausgleichseinstellung]
wurde durch einen Biss in einem Fremdkörper (z. B. Metall) verursacht
Der Patient hat die anamnestischen Daten verschwiegen
wurde durch unsachgemäße Handhabung des Ersatzes verursacht
wurde durch unsachgemäße Handhabung der Prothese außerhalb der Mundhöhle verursacht
wurde durch das Entfernen temporärer Restaurationen ohne Wissen des Arztes verursacht (dies kann die Zähne beschädigen, die die Säulen für die prothetische Arbeit sind).

Die Garantie gilt auch nicht für das Wiederauftreten von Zahnkaries, das durch ordnungsgemäße Pflege, regelmäßige Zahnreinigung, Verwendung von Arzneimitteln, sofern vorgeschrieben, und Einhaltung regelmäßiger Vorsorgeuntersuchungen verhindert werden kann.

5.4 Der Patient kann jederzeit vor Ablauf der Garantiezeit für ein bestimmtes Verfahren / Produkt einen Anspruch aus dieser Garantie geltend machen. Der Patient muss den Anbieter per Telefon oder E-Mail an die auf der Website angegebene Adresse kontaktieren, indem er das Formular auf der Website ausfüllt oder schriftlich über die Meldung der Beschwerde informiert. Der Anbieter wird dem Patienten einen Behandlungstermin geben. Der behandelnde Arzt entscheidet über die Berechtigung der Garantie. Der Patient ist verpflichtet, bei der Planung eines Arzttermins die Art des Problems anzugeben. Wenn die Beschwerde berechtigt ist, wird die Reparatur oder der Austausch je nach Art der Beschwerde sofort durchgeführt oder für einen geeigneteren Tag und eine geeignetere Uhrzeit geplant. Wenn die Prothese ausgetauscht werden muss, muss der Patient die Zeit berücksichtigen, die für die Installation, Reparatur oder Modifikation des Prothesenteils erforderlich ist.

Privatsphäre

6.1 Alle personenbezogenen Daten des Kunden (im Sinne dieses Artikels kann der Kunde als „betroffene Person“ bezeichnet werden) werden gemäß den Bestimmungen des Gesetzes Nr. 122/2013 Slg., Die Bestimmungen des Gesetzes Nr. 576/2004 Coll und die Bestimmungen der einschlägigen Gesetzgebung.

6.2 Die betroffene Person erklärt sich hiermit damit einverstanden, dass der Betreiber seine personenbezogenen Daten in folgenden Bereichen verarbeitet: Name und Nachname, ständiger Wohnsitz, Geburtsnummer, Geburtsdatum, Telefonnummer und E-Mail-Adresse zum Zweck: Erbringung von Rettungsdiensten, Registrierung von Kalenderdaten, statistische Auswertungen.

6.3 Der Betroffene hat das Recht, seine Einwilligung jederzeit zu widerrufen. Der Widerruf der Einwilligung berührt nicht die Rechtmäßigkeit der Verarbeitung, die sich aus der Einwilligung vor ihrem Widerruf ergibt. Die betroffene Person hat das Recht, ihre Einwilligung zu widerrufen, indem sie eine Benachrichtigung per E-Mail an die E-Mail-Adresse der City Clinic s.r.o. gdpr@cityclinic.eu oder per Post an die Adresse des eingetragenen Sitzes des Anbieters Prievozská 14, Bratislava 821 09.

6.5 Der Anbieter ist berechtigt, Verarbeitungsvorgänge durchzuführen, die dem Zweck der Verarbeitung entsprechen, nämlich: personenbezogene Daten zu erfassen, zu sammeln, aufzuzeichnen, zu organisieren, neu zu gruppieren, zu kombinieren, zu durchsuchen, zu übertragen, zu speichern, zu kopieren, zu scannen, verfügbar zu machen und zu entsorgen; Überprüfen Sie ferner die Richtigkeit der bereitgestellten personenbezogenen Daten, um personenbezogene Daten in den aufbewahrten Unterlagen, Aufzeichnungen und zugehörigen Aufzeichnungen während des Archivierungszeitraums zu speichern, der durch allgemein verbindliche gesetzliche Bestimmungen festgelegt ist.

Der Anbieter haftet nicht für die Folgen, die sich aus dem Mangel an Informationen des Kunden über die Verarbeitung der personenbezogenen Daten des Kunden ergeben.

Gesundheitsversorgung für eine Person, die nicht in der Lage ist, eine Einverständniserklärung abzugeben (im Folgenden “nicht berechtigter Patient”)

7.1 Minderjährige, Personen ohne Rechtsfähigkeit und Personen mit eingeschränkter Rechtsfähigkeit gelten als nicht in der Lage, eine Einverständniserklärung abzugeben.

7.2 Ein gesetzlicher Vertreter handelt im Namen eines nicht berechtigten Patienten.

7.3 Bei der Erbringung von Gesundheitsleistungen ist der behandelnde Angehörige der Gesundheitsberufe verpflichtet, die Meinung eines unzulässigen Patienten zu berücksichtigen, insbesondere ist er verpflichtet, die wesentlichen Tatsachen seines Gesundheitszustands in Bezug auf sein Alter und seine geistige Reife nachvollziehbar zu erläutern. Der gesetzliche Vertreter wird vom behandelnden medizinischen Fachpersonal vollständig unterrichtet.

7.4 Unvollständigkeit oder Entzug / Einschränkung der Rechtsfähigkeit des Patienten ist kein Grund für die Verletzung seiner Persönlichkeitsrechte, die der Leistungserbringer und der behandelnde Arbeitnehmer im Gesundheitswesen in vollem Umfang zu respektieren haben.

7.5 Der gesetzliche Vertreter ist verpflichtet, dem Anbieter uneingeschränkt mitzuarbeiten, damit die Aktualität und Vollständigkeit der Gesundheitsversorgung, die der Gesundheitszustand des nicht berechtigten Patienten erfordert, nicht gefährdet wird.

7.6 Der gesetzliche Vertreter des Patienten muss durch Unterzeichnung einer schriftlichen Einverständniserklärung bei der Erbringung der Gesundheitsversorgung nachweisen und bestätigen, dass er der gesetzliche Vertreter des Klienten ist.

Streitbeilegung und Haftung für Schäden

8.1 Die Vertragsparteien verpflichten sich, etwaige Streitigkeiten oder Missverständnisse in erster Linie durch gegenseitige Kommunikation beizulegen.

8.2 Bevor eine Partei Maßnahmen ergreift / eine Beschwerde einreicht (z. B. bei der Gesundheitsaufsichtsbehörde, einer Strafverfolgungsbehörde, einem Gericht) oder das Problem in den Medien veröffentlicht (Medienberichterstattung umfasst auch soziale Netzwerke), ist sie verpflichtet die andere Partei schriftlich aufzufordern, den Streit beizulegen und ihr eine Frist von 15 Tagen ab dem Datum des Eingangs der Ladung zu geben, um eine Stellungnahme abzugeben.

8.3 In jeder Phase der Streitbeilegung verpflichten sich die Parteien, so vorzugehen, dass der gute Name und das Ansehen der anderen Partei nicht geschädigt werden.

8.4 Der Patient erkennt an, dass die Art der Gesundheitsversorgung beim Anbieter die Aufbewahrung persönlicher Gegenstände (wie Teile von Kleidung, Dokumenten usw.) erfordern kann. Zu diesem Zweck behält sich der Anbieter einen Platz zur Aufbewahrung persönlicher Gegenstände von Patienten während der Erbringung der Gesundheitsversorgung vor, so dass der Patient verpflichtet ist, seine persönlichen Gegenstände immer in dem Raum aufzubewahren, in dem er sich entsprechend der Art der erbrachten Gesundheitsversorgung aufhält . Der Patient erklärt, diese Bestimmung des Anbieters verstanden zu haben und erkennt sie an. Der Anbieter haftet nicht für Schäden an Gegenständen, die der Patient an einem anderen als dem dafür vorgesehenen Ort aufbewahrt.

Gutscheine

9.1 Der Patient hat das Recht, einen auf der Website des Anbieters angebotenen Gutschein zu erwerben.

9.2 Der Patient erwirbt das Recht, einen Gutschein zu verwenden und darin definierte Rabatte und Leistungen einmal vollständig oder nacheinander für die eingeschlossenen medizinischen Leistungen zu beziehen. Der Gutschein muss den Mitarbeitern des Anbieters vor der Erbringung medizinischer Dienstleistungen innerhalb einer im Voraus vereinbarten Frist vorgelegt werden.

9.3 Der Gutschein ist zeitlich begrenzt. Die zeitliche Gültigkeit des Gutscheins und die Zeichnungsbedingungen sind direkt auf dem Gutschein oder auf der Website des Anbieters angegeben. Wenn die zeitliche Gültigkeit des Gutscheins nicht auf dem Gutschein oder auf der Website angegeben ist, ist der Gutschein 1 Jahr ab dem Datum der Zahlung gültig. Der Patient ist verpflichtet, sich mit den Nutzungsbedingungen vertraut zu machen und diese einzuhalten.

9.4 Vor Beantragung des Gutscheins ist der Patient verpflichtet, den Anbieter telefonisch oder per E-Mail zu kontaktieren und rechtzeitig einen Termin zu vereinbaren.

9.5 Nach Ablauf des Gutscheins verliert der Patient das Recht, Rabatte und Vorteile aus dem Gutschein zu gewähren, ohne Anspruch auf Rückerstattung.

9.6 Der Patient hat das Recht, den Empfänger des Gutscheins einmal zu ändern, wenn er den Anbieter per E-Mail an die auf der Website veröffentlichte Adresse des Anbieters informiert. Informationen über den neuen Empfänger müssen ausschließlich per E-Mail bereitgestellt werden.

9.7 Wertcoupon und Geschenkwertcoupon (im Folgenden zusammenfassend als „Wertcoupon“ bezeichnet) werden ausschließlich verwendet, um den darauf angegebenen Betrag mit dem Betrag für vom Anbieter erbrachte Dienstleistungen zu verrechnen. Der Kunde ist berechtigt, den Gutschein vom Zeitpunkt des Eingangs bis zum Ende der auf der Website des Anbieters oder auf dem Gutschein selbst angegebenen Gültigkeit für den Wert zu verwenden.

Servicepakete

10.1 Der Patient hat das Recht, ein oder mehrere Pakete aus dem aktuellen Angebot des Anbieters zu erwerben. Die Anzahl der angebotenen Pakete und deren Namen werden vom Anbieter festgelegt.

10.2 Das Paket ist ab Kaufdatum zeitlich auf ein Jahr begrenzt. Mit dem Kauf des Pakets stimmt der Patient den Nutzungsbedingungen der im Paket enthaltenen Dienstleistungen zu.

10.3 Der Patient ist verpflichtet, die Grundregeln für die Bestellung und Buchung eines Termins einzuhalten, wenn er die Vorteile aus dem gekauften Paket oder mehreren Paketen in Anspruch nimmt.

10.4 Im Fall eines Familienpakets ist es keine Bedingung, dass die Personen, die davon profitieren, in einer familiären Beziehung stehen, aber es ist eine Bedingung, dass die Personen, die von diesem Paket profitieren, maximal 4 Personen sind.

10.5 Nach Ablauf der Gültigkeit eines bestimmten Pakets verliert der Patient das Recht, die daraus resultierenden Leistungen in Anspruch zu nehmen, auch wenn er diese Leistungen während der Gültigkeitsdauer nicht in Anspruch genommen hat.

10.6 Das gekaufte Paket ist nicht übertragbar. Nach dem Kauf des Pakets ist es nicht möglich, den Empfänger der daraus resultierenden Vorteile zu ändern. Für den Fall, dass der Patient die Dienste und Leistungen aus unvorhergesehenen, unvorhersehbaren Gründen und aus Gründen, die der Patient nicht selbst verursacht hat, nicht nutzen kann, wird nach Vereinbarung mit dem Anbieter ein anteiliger Betrag zurückerstattet.

10.7 Im Falle des Ablaufs der Gültigkeit des Pakets oder der Erschöpfung aller daraus resultierenden Vorteile hat der Patient die Möglichkeit, es erneut zu kaufen.

Gemeinsame und endgültige Bestimmungen

11.1 Die Änderung der AGB wird durch einen Hinweis auf der Website cityclinic.sk des Anbieters oder in Form einer E-Mail an die private E-Mail-Adresse des Patienten angekündigt, die in seiner medizinischen Dokumentation angegeben ist.

11.2 Die im Vertrag festgelegten Rechtsbeziehungen, die darin nicht ausdrücklich geregelt sind, unterliegen dem Recht der Slowakischen Republik.

11.3 Wenn einige Bestimmungen der AGB ganz oder teilweise nicht gültig oder wirksam sind oder später ihre Gültigkeit oder Wirksamkeit verlieren, hat dies keinen Einfluss auf die Gültigkeit oder Wirksamkeit anderer Bestimmungen der AGB. Anstelle ungültiger und / oder unwirksamer Bestimmungen sind Rechtsvorschriften anzuwenden, die der Bedeutung und dem Zweck der Bestimmung, die von Ungültigkeit oder Unwirksamkeit betroffen sind, so nahe wie möglich kommen.

11.4 Um Unstimmigkeiten und Zweifel zu vermeiden, gilt jede Sendung, die von einer der im Vertrag genannten Vertragsparteien per Post versandt wird, nach 5 Arbeitstagen ab Versanddatum an den Adressaten geliefert, es sei denn, die Lieferung wurde nachgewiesen ein früheres Datum.

11.5 Für den Fall, dass gemäß dem Vertrag oder den AGB eine Benachrichtigung des Patienten durch einen Hinweis auf der Website des Anbieters angenommen wird, gelten diese Benachrichtigungen als am Tag ihrer Veröffentlichung auf der Website angekündigt.

11.6 In Fällen, in denen eine Benachrichtigung des Patienten per E-Mail erwartet wird, gilt diese Benachrichtigung zum Zeitpunkt des Versands als benachrichtigt. Wenn die E-Mail-Nachricht außerhalb der Arbeitstage (d. H. Samstag, Sonntag, arbeitsfreie Tage und Feiertage) gesendet wurde, gilt der Tag der Zustellung als 09:00 Uhr am nächsten folgenden Arbeitstag.

11.7 Jede Änderung oder Ergänzung des Vertrags oder der AGB bedarf einer schriftlichen Form.

11.8 Mit der Unterzeichnung verpflichtet sich der Patient, die in den AGB vereinbarten Bedingungen einzuhalten. Gleichzeitig bestätigt der Patient mit seiner Unterschrift, dass er die AGB ausführlich gelesen hat und dass ihm vom Anbieter etwaige Unklarheiten erklärt wurden.

11.9 Bei Unstimmigkeiten zwischen der slowakischen und der englischen Version der AGB hat die slowakische Version Vorrang.

Versicherungsunternehmen

Der Patient zahlt den vollen Betrag für die erbrachte Gesundheitsversorgung gemäß der gültigen Preisliste. Die in der Preisliste genannten Beträge verstehen sich als Ergänzung zum Beitrag der Versicherungen. Die Vergütung für die erbrachten Leistungen, die Zahlungsweise und das Fälligkeitsdatum sind in den Allgemeinen Geschäftsbedingungen für die Gesundheitsfürsorge der City Clinic, s.r.o. aufgeführt.
